H2B – Nonagricultural

Requirements:

  • Employer must be a non-agricultural employer that has a seasonal or temporary recurring need lasting no more than 9 months each year.
  • Pay for transportation from the Consulate to your location at the beginning of the work contract and for their transportation home at the end.
  • Provide daily transportation to and from job sites.
  • Furnish all tools and supplies necessary for the position at no cost to the workers
  • Pay the required wage set by DOL for your county and follow the 3/4 guarantee. For certified periods of employment lasting fewer than 120 days: The employer guarantees to offer work for hours equal to at least three-fourths of the workdays in each 6-week period of the total employment period. OR For certified periods of employment lasting 120 days or more: The employer guarantees to offer work for hours equal to at least three-fourths of the workdays in each 12-week period of the total employment period.
  • Attempt to recruit U.S. workers prior to being approved for visas. H2 Labor Assistance will set all ads to run and open the job order with the State Workforce Agency. You will be required to accept applications until 21 days before your start date.
  • Withhold all regular local, state and federal payroll taxes.
